- KOM Coaching (& KOM Challenges) may use your contact information to keep you informed or to notify you of other services and events events organised or promoted by KOM Coaching (& KOM Challenges).
- Information will never be shared with third party organisations unless essential for your participation in an event.
- Participants give permission for KOM Coaching ( KOM Challeges), their agents, or any other associated organisations to use any photographs, video tapes, motion pictures, digital images, sound recordings, or any other record of the event. Such articles may be used or included on websites, media publications, advertising, promotional information, or other publicly accessible sources.
KOM CHALLENGES
TERMS & CONDITIONS
KOM Challenges are run by KOM Coaching. This document constitutes an agreement between you (the Participant). and KOM Coaching. Taking part in KOM Challenges is strictly conditional upon the Participant agreeing to all of the terms and conditions contained within this document (the Agreement). All Participants must acknowledge that they have read and accept this agreement before completing the Challenges. All Participants under the age of 18 years must be registered by their parent or legal guardian.
KOM CHALLENGES – OUTLINE
- KOM Challenges are not events.
- By participating in KOM Challenges, Participants are buying a medal on completion of the Challenge.
- There are no time limits of the completion of any challenge??
- Participants choose their own routes in order to complete the Challenge and ride them at their own risk.
- Routes and descriptions on the KOM Coaching website are for illustration purposes. They are routes that KOM Coaching have ridden but are NOT routes that must be followed.
- The onus is on Participants to decide what routes to take and to ensure that they are safe to ride at the given time in the given weather conditions.
- KOM Coaching are not responsible for the route choices of the Participants or the weather conditions at the time the Participant chooses to ride said route.
- Participants are responsible for ensuring the accuracy of their personal records within the event database. Should any information change between registration and participation, it is the individual Participants’ responsibility to ensure that their records are updated accordingly.
- Participation in the Challengeswill only be accepted through the official website, using the online registration system or that of official partners as stated.
- Participation fees indicate that the Participant has set themselves the rlevant Challenge. There is no time limit to complete the Challenges, the fees paid are therefore NON REFUNDABLE under any circumstance.
- Entrants must electronically acknowledge that they have read and agree to the event terms and conditions prior to their entry in to the event being confirmed. By doing so the entrant is unreservedly accepting all of the terms and conditions of this agreement.
- All entrants under the age of 18 years must be registered by their parent or legal guardian.
PERSONAL ABILITY TO PARTICIPATE
- Participants are solely responsible for deciding if they are fit and healthy to complete the challenges
- It is the Participants’ responsibility to ensure they train appropriately and have the requisite level of fitness to be able to complete their chosen Challenge
- Participants must ensure their personal health is suitable for participating in the Challenges. If in any doubt the entrant should consult their doctor.
- Participants must be competent cyclists and confident in their ability to complete their chosen Challenge
CYCLING CODE OF CONDUCT
- KOM Challenges are NOT races. They are non-competitive on-road personal endurance cycling challenges.
- Participants are strongly advised to wear an approved Cycle Safety Helmet at all times when riding the Challenges.
- When riding in groups, never cycle more than two abreast and always single out on narrow or busy roads, as per the Highway Code.
- Take extra care where in areas where there are horses. Make your presence known by by talking (not shouting) and give riders time to steady their horse. Pass slowly when safe to do so.
- You MUST comply with all road traffic signs and markings.
- Participants must ride in accordance with the law and adhere to the Highway Code.
- Participants are responsible for riding safely and with due respect for other road users and the other participants in the event.
PARTICIPATION IN CYCLING CHALLENGES
- Participantsare responsible for ensuring their bike is serviceable and fit for purpose.
- Participants are strongly advised to carry a suitable bicycle repair kit sufficient to maintain the serviceability of their bike in the event of punctures or other minor mechanical failures.
- Participants are reminded to consider how to manage their own nutritional requirements throughout the duration of the .
- Medals will be awarded to participants completing their chosen Challenge on the Participant providing evidence of completion of the Challenge.
- Participants assume full and complete responsibility for any injury or accident which may occur whilst travelling to or from the Challenges and during any attempt at a Challenge.
- Participants must agree to waive, release and forever discharge the Challenge organisers, sponsors, promoters, and each of their agents, representatives, successors and assigns, and all other persons associated with the Challenges, from any liabilities, claims, actions, or damages that they may have against them arising out of or in any way connected with participation in the Challenges. This includes any claims, whether caused by negligence, the action or inaction of any of the above parties, or otherwise.

GENERAL PROVISIONS
- This agreement constitutes the whole agreement between the parties and any prior agreement, oral or written, are excluded.
- Any failure by any party to enforce or to exercise at any time any term or any right under this agreement shall not be deemed to be a waiver of that term or right and shall not affect that party’s right to later enforce or to exercise it.
- If any term of this agreement is found to be illegal or unenforceable it shall be deemed to be omitted from the agreement and shall not affect the validity of the remainder of the agreement.
- Nothing in this agreement confers any right on third parties to enforce the provisions of this agreement under the Contracts (Rights of Third Parties) Act 1999.
- The laws of England & Wales shall govern this agreement
